Shops Use Of CCTV

Tue Nov 11, 2014 4:40 pm

I am new to posting on this site.

I have been arbing for a while and know many in the industry.

A friend of mine who is a trader at a major chain (I want to protect him more than I want to shame his organisation so I am choosing not to say which major chain it was) phoned me on Friday to tell me that one of the other traders had used CCTV in a shop to forward my picture to their retail estate.

Is this allowed? I had believed they were only allowed to do this in the event of a crime or if they believed I was a threat to their staff??? I lasted only 3 bets in a shop I have never been to before before the inevitable telephone call. However in the process of the PTL conversation the trader has decided to view the shops CCTV and forward a screenshot of me to other shops to make sure I couldn't get on their  either/ Is this legal? Surely it is gross infringement of my rights and total abuse of the security facilities??

Suppose that they distribute your picture to all shops of the chain. Who is going to take a look? I believe no one. And if they send all pictures of those who take sharp lines, then the photoalbum will be an encyclopedia.
As for the question about if it is legal or not, you have to check with your country's law. You are not telling us where you come from. If you want to protect your rights from this bookmaker, you must be able to prove these facts.

I am based in England and it was a major UK chain,

I thought it was illegal to use it for something other that security unless it was displayed by readable signage that they use it for reasons other than security.

Obviously I can't take any action without dropping my mate right in it, so I will not take any action, I was just surprised, I am used to a description being sent out to all shops will a till message to staff but not camera footage.

I am aware that they have cameras, and know that they are allowed to use them for security. However my understanding was that if you wanted to use it for business intelligence gathering there had to be clear signage letting customers know.

Casinos in the UK presumably use cameras for similar reasons. Do the have such signs on display?

Its never a pleasant experience being refused bets but the same rules apply as arbing online

Do you really want to take big stakes on a small arb on a rubbish football match and do it several times a week and maybe several times a day to the point cashier / trader can remember your last bet.

If you clearly stand out as betting big on bad prices you only have yourself to blame.

Its their ball you are playing with whether its shop or online and they can take it away whenever they like. They can use their cctv however they like.

actually legally they should not be distributing your photograph. remember we arbers are not criminals.
we are not breaking any laws, a bookmaker offers us odds, we decide to accept them, never in a million
years could they justify in a court of law that this behaviour is acceptable!

in the UK we have the Data Protection act and in the EU the Human Rights act, both prohibit this type
of behaviour

"The main legal consideration to take before releasing an image or CCTV
footage is the Human Rights Act, to ensure a balance is struck between an
individual’s right to a fair trial and a private life versus public interest and the
prevention of crime and disorder. You need to consider whether release of the
image is lawful, proportionate and necessary"

Casinos only use their cameras for security and to identify cheats and criminal behaviour.

Arbing is not cheating, nor is it criminal - you are accepting a quoted price that they have chosen to offer.

I asked someone today and apparently it was not legal for them to do it without my knowledge, apparently supermarkets got in trouble for doing it a few years ago before they made it public that it might happen.

I could take it further but then they will just put signs in all the shops and pass the costs on to the customers by adjusting their book a fraction.

I strongly doubt that they would do something like that because they need the flow of average gamblers. They wouldn't want to frighten them.

Casinos have also used cameras to detect card counters who aren't doing anything illegal.

This is true but it used to be the case that when you joined a casino it was mentioned that CCTV was in operation and that the management reserved the right to use it in whatever way they liked, and that by continuing with the application process you were agreeing to these terms and conditions.

I've been in William Hill before and seen the monitors behind the counter show a CCTV image from a different shop with a message saying 'do not serve this guy', one time it even had a name of the person. Another type of customer they don't like are 'slow counters' and they send alerts for that.
