Betting taxes in Spain

Here is a question for our members from Spain.
We know that Spanish bettors are obliged to declare their betting winnings as taxable income. But what if someone has large profits from on line betting and at the same times large losses from betting in the shops?
Will losses be deducted from profits if losing slips are presented to the taxman?

The answer is no.

Someone could take a lot of lost bets from the rest of the bettors.

They do not accept this.

I ask HRMC in Spain.

I asked HRMC and you cannot do this trick.

Vallejo is something different.

The law in Spain doesn't count losses until 2011, so you can imagine the injustice.

You win 5M, you lose 5.1M, and you pay taxes for the 5M that you won. Absolutely nonsense.

About your proposition, until shop betting is unknown, they will not count it, because you can hide your winnings.

You can do in the other side. People that have a lot of cash from ilegal business do this. I saw with my own eyes. They bet both sides, i hope that they go to HRMC with the won leg, and the money is now white.

No. I asked HRMC face to face, when they required me to pay for my winnings, some years ago. I went with some lost bets from shops, and the inspector told me that this is no possible to mix online and shop, in this way.

Anyway, if you want i will ask them again, via mail, and see if something change. This information is from 2017 aproximatly.

So you had to pay them? And, did they "catch" you or did you denounce yourself?

Actually in Spain it is possible to declare net profit from prizes derived from gambling as long as (and this is important) you have means of proof generally accepted in law, i.e. in the case of tickets you must ensure that these are nominal (documentary proof and accounting proof) or failing that you can justify their ownership through the electronic register of operators who are omnichannel (they have online and offline gambling), but not all operators or venues facilitate or have that possibility of management. Therefore, a bettorr who is interested in this part should make sure of this information beforehand.

In gambling this rarely happens to bettors due to the lack of importance given to it by the players, but in the case of poker in casinos it is very common to request buy-ins from the management in order to have documentary proof.

The online bets yes, but offline no. But in offline you win a bet more than 2000 eur you must make a request for the shop can pay you.
